International students in Australia were hoping for a relaxation of their work hours temporarily. It is, however, good news for the anxious lot after the Morrison government made recent provisions in relaxing the work limits owing to workforce shortages. These youngsters can work in all sectors of the country’s economy provided they are student visa holders. The announcement is for both current students and even new student arrivals. Interestingly, the provision will allow them to start the job before the commencement of the course. With this, students can work before the start of the course. They can benefit by working over 40 hours every fortnight in any sector. Even secondary applicants can benefit from the development. Even though it is an arrangement temporarily, it will be reviewed by the Federal Government in April this year, sources said. Benefits if you are a student visa holderIf international students travel to the country between January 19 and March 19, they get a refund for the Australian student visa 500 application charge. They can apply for it till December 31. At the same time, you can continue to balance study and work commitments despite flexibility in the work hours. Students have to-- - Maintain enrolment of the course - Ensure course attendance, and - Ensure course progress There can be a breach in Australian student visa conditions if any visa holder cancels enrolment, stops attending classes, or even fail to meet course progress. If students are working or have an employment offer in any important sector or completed courses, they can be eligible for a subclass 408 COVID-19 visa. Besides, you can apply for the visa 3 months in advance (90 days) before the expiry of the Australian student visa. What it means if you are an employerAt the most, every Australian employer has to abide by the country’s workplace law. Like other employees, international students have the same rights as per Australian law. Keeping in mind these measures, the DHA (Department of Home Affairs) and ABF (Australian Border Force) will— Exercise discretion under s116(1)(b) of the Migration Act 1958. As per the Act provisions, there will not be any student visa issues for students. They can exceed work beyond 40 hours every fortnight. The authorities will not refer Australian 500 visa holders for any investigation of a potential violation under the s235 of Migration Act 1958. Students should not violate the number of hours as per the visa guidelines. Otherwise, it can lead to the breach of visa conditions.
